Mandatory Well Registration Now Has Enforcement Teeth The board approved well-registration enforcement changes to the Rules and Regulations, which now tie well registration compliance directly to your ability to carry over or transfer Tier 1 and Tier 2 water allocations. If you are not in compliance with the rules—including registering all wells (agricultural, domestic, and retired/non-destroyed)—you will lose the ability to carry over water into future years and will not be able to transfer native sustainable yield. A civil penalty of up to $1,000 plus $100/day may also be imposed, though the board discussed using loss of good standing and allocation flexibility as a primary motivator first.
