1. Riparian Areas Can Now Be Permanently Designated as Inactive — Excluding Remote-Sensing ET from These Areas The Board approved a modification to the Groundwater Allocation Rule that allows growers to permanently designate naturally vegetated, non-cultivatable riparian areas (e.g., along rivers, creeks, vernal pools) as inactive through the Groundwater Accounting Platform (GAP). This means any evapotranspiration picked up by remote sensing (OpenET) on those riparian areas will not be counted as consumptive use for those relying on remote sensing. Designated riparian areas must total at least 7 acres per parcel (individual areas must be at least 1 acre), and areas along waterways must average at least 150 feet wide. Once designated, these areas are permanently inactive and cannot be switched back to irrigated status. The GAP update and attestation form are expected to be available within approximately 30 days; an announcement will be made when growers can begin submitting designations. Note: this does not apply to man-made features like canals, ditches, reservoirs, or holding ponds.
